Welcome to Circle E Buildings LLC ("Circle E Buildings," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your purchase of buildings and related services from Circle E Buildings. By placing an order, requesting a quote, or using our website https://circleebuildings.net or https://circleebuildings.com, you agree to be bound by these Terms.

Please read these Terms carefully before placing an order. If you do not agree with these Terms, do not place an order or use our services.

2. Products and Services

Circle E Buildings manufactures, delivers, and installs custom portable buildings including:

• Storage sheds
• Garages
• Barns
• Carports
• Workshops
• Cabins
• Greenhouses

All buildings are custom-manufactured to order based on customer specifications and our available options.

3. Quotations and Pricing

3.1 Obtaining a Quote

Pricing for our buildings is available by:

• Requesting a quote through our website at circleebuildings.com
• Calling us at 850-324-2424

3.2 Quote Validity

All quotes are valid for 30 days from the date of issuance unless otherwise specified. Prices are subject to change based on material costs, customization options, and market conditions. Once you accept a quote and submit your deposit, the quoted price is locked in for your order.

3.3 Customization

Customers must finalize all customizations to the design, size, color, and features of their building before accepting the quote and making the initial payment. We cannot guarantee that changes can be accommodated after quote acceptance and down payment. Any approved changes after order placement may result in additional costs and delivery delays.

4. Payment Terms

4.1 Outright Purchase

For customers purchasing a building outright:

• Deposit: 50% down payment is required at the time of order
• Final Payment: The remaining 50% balance is due in full upon delivery of the building
• Payment Methods: We accept cash, check, credit card, and wire transfer

4.2 Rent-to-Own

For customers choosing the rent-to-own option:

• A small down payment is required as dictated by our rent-to-own service provider, JMAG LLC (https://jmagllc.com)
• The building remains the property of JMAG LLC until paid in full
• Rent-to-own terms are governed by a separate agreement between the customer and JMAG LLC
• Circle E Buildings is not a party to the rent-to-own agreement and is not responsible for terms, payment collection, or disputes related to rent-to-own financing

4.3 Non-Sufficient Funds

There will be a $50 charge for any checks returned due to non-sufficient funds (NSF).

4.4 Default and Repossession

In the event of incomplete payment or payment default for outright purchases, Circle E Buildings LLC reserves the right to enter the property without prior notice and repossess the building.

5. Order Cancellation and Refunds

5.1 Customer Cancellation

Customers have a 3-day right of cancellation from the order date with no penalty. Cancellations made after 3 days from the order date are subject to a 15% restocking fee, which will be deducted from any refund due.

5.2 Company Cancellation

Circle E Buildings reserves the right to cancel an order at any time before delivery due to circumstances including but not limited to material shortages, manufacturing issues, or inability to access the delivery site. In such cases, we will provide a full refund of all payments made.

5.3 Refund Processing

Approved refunds will be processed within 14 business days using the original payment method.

6. Manufacturing and Delivery Timeline

6.1 Lead Time

Custom-built buildings typically have a lead time of 6-8 weeks from the date of order and deposit. This timeframe is an estimate and not a guarantee.

6.2 Expedited Orders

Customers may request expedited delivery. We will make reasonable efforts to accommodate expedited requests when possible, but cannot guarantee availability of expedited service.

6.3 Delays

Delivery dates are estimates and may be subject to delays due to:

• Weather conditions
• Material shortages or supply chain issues
• Manufacturing complications
• Site access issues
• Other circumstances beyond our reasonable control

Circle E Buildings is not liable for any damages, losses, or expenses resulting from delivery delays. We will make reasonable efforts to notify customers of significant delays.

7. Delivery and Installation

7.1 Free Delivery Zone

Delivery and setup are provided free of charge within 75 miles of our dealer locations.

7.2 Extended Delivery

Deliveries over 50 miles from a dealer location are charged at a rate of $4 per mile for the distance exceeding 50 miles.

7.3 Setup Included

Our delivery service includes up to 45 minutes of setup time. Additional setup time beyond 45 minutes is billed at $75 per hour.

7.4 Site Preparation - Customer Responsibility

The customer is responsible for:

• Providing a compacted, level pad for the building
• Ensuring adequate access to the delivery site for our delivery vehicles and equipment
• Clearing any obstacles (trees, power lines, fences, etc.) that may interfere with delivery
• Obtaining all necessary building permits and ensuring compliance with local zoning regulations and building codes
• Obtaining written permission from neighboring property owners if their property must be crossed or entered during delivery

7.5 Access and Site Conditions

Circle E Buildings LLC is not responsible for damage to the customer's yard, landscaping, driveway, or property resulting from delivery when such damage is caused by:

• Lack of adequate access to the site
• Unfavorable ground conditions (soft soil, mud, slopes, etc.)
• Hidden underground utilities, septic systems, or irrigation systems
• Weather conditions

7.6 Failed Delivery

If delivery cannot be completed due to site access issues, inadequate site preparation, or other customer-related factors, the customer will be responsible for any additional delivery charges incurred for a subsequent delivery attempt. If the site conditions make delivery impossible or unsafe, the customer may be required to choose an alternative location or cancel the order subject to the cancellation policy in Section 5.

8. Warranties

8.1 Workmanship Warranty

Circle E Buildings provides a lifetime warranty on workmanship for the life of the building. This warranty covers:

• Structural defects in construction
• Construction quality issues
• Faulty installation

8.2 Warranty Exclusions

The workmanship warranty does NOT cover:

• Weather-related damage (wind, hail, snow load, flooding, etc.)
• Normal wear and tear
• Customer modifications or alterations to the building
• Neglect or failure to maintain the building
• Damage caused by moving or relocating the building after initial installation
• Damage caused by improper use or use for purposes other than intended
• Damage caused by settling or shifting of the foundation/pad not maintained by the customer
• Acts of God, vandalism, or accidents

8.3 Warranty Maintenance

To maintain warranty coverage, the customer must exercise prudent care of the building, including:

• Keeping the building level and properly supported
• Performing reasonable maintenance and upkeep
• Promptly reporting any defects to Circle E Buildings

8.4 Warranty Claims

To make a warranty claim, contact us at circleebuildings@gmail.com or 850-324-2424. We will evaluate the claim and, if valid, repair or replace the defective components at our discretion. The warranty is limited to repair or replacement and does not include consequential damages.

8.5 Warranty Transfer

The workmanship warranty is transferable to subsequent owners of the building provided the building remains on the original installation site and has been properly maintained.

8.6 Materials Warranty

Materials and components used in our buildings may be covered by manufacturer warranties. Such warranties are passed through to the customer and are subject to the manufacturer's terms and conditions.

9. Permits and Regulations

The customer is solely responsible for:

• Obtaining all necessary building permits prior to delivery
• Ensuring the building complies with all local, state, and federal regulations
• Compliance with homeowners association (HOA) rules and restrictions
• Compliance with zoning ordinances and setback requirements
• Any fines, penalties, or costs associated with non-compliance

Circle E Buildings does not provide permit assistance or guarantee that our buildings will comply with local regulations. We recommend consulting with local authorities before placing an order.

10. Limitation of Liability

To the fullest extent permitted by law:

• Circle E Buildings' total liability for any claim arising from the sale, delivery, or installation of a building shall not exceed the purchase price paid for that building
• We are not liable for indirect, incidental, special, consequential, or punitive damages
• We are not liable for damages arising from delays in delivery, inability to deliver, or defects not covered by our warranty
• We are not liable for damages to property, landscaping, or underground utilities during delivery except as caused by our gross negligence or willful misconduct

11. Indemnification

The customer agrees to indemnify, defend, and hold harmless Circle E Buildings LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from:

• The customer's failure to obtain necessary permits or comply with regulations
• Injury or damage occurring on the customer's property during or after delivery
• The customer's use or misuse of the building
• Crossing or entering neighboring properties for delivery purposes

12. Force Majeure

Circle E Buildings is not liable for failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, pandemics, material shortages, or supplier failures.

13. Entire Agreement

These Terms, together with your accepted quote and any written addendums, constitute the entire agreement between you and Circle E Buildings regarding your purchase. These Terms supersede any prior oral or written agreements.

14. Modifications to Terms

Circle E Buildings reserves the right to modify these Terms at any time. Updated Terms will be posted on our website with a new effective date. Terms in effect at the time of your order will govern your purchase.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising from these Terms or your purchase shall be resolved in the state or federal courts located in Escambia County, Florida, and you consent to the exclusive jurisdiction of such courts.

17. Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. No waiver shall be effective unless in writing and signed by an authorized representative of Circle E Buildings.

18. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Circle E Buildings may assign these Terms at any time without notice.
